1. Introduction

WellNest (Pty) Ltd operates a South Africa based medical and wellness platform facilitating access to registered healthcare practitioners for in person and virtual consultations, diagnostics, treatment planning, and wellness services.

By accessing this website or using any WellNest service, you agree to these Terms and Conditions. If you do not agree, please do not use this platform or services.

2. Medical practitioners

Medical services made available through WellNest are rendered independently by registered healthcare practitioners, including:

• Dr Mogammad Raythaan Addinall, Practice Number: 1176358
• Dr Juniene Probart (De Vries), Practice Number: 1293540

Each practitioner practices independently, within their professional scope and ethical obligations, and remains solely responsible for all clinical decisions, diagnoses, prescriptions, and treatments. WellNest does not practice medicine and does not interfere with clinical judgment.

3. Scope of services

Services may include:

• Medical consultations (in person or telehealth)
• Preventative and lifestyle medicine
• Longevity and wellness assessments
• Diagnostic interpretation
• Treatment planning
• Prescriptions where clinically appropriate
• Dispensing of medication or supplements where permitted by law

All services are provided only after appropriate medical assessment and at the discretion of the attending practitioner.

4. Telehealth limitation

Telehealth services are offered only to patients physically located within South Africa at the time of consultation, in accordance with applicable laws and HPCSA guidelines.

5. No guarantee of results

Medical and wellness services involve inherent uncertainty.

WellNest and its practitioners make no guarantees regarding:

• Medical outcomes
• Therapeutic success
• Disease prevention
• Longevity enhancement
• Fitness or performance improvement

Individual results vary.

6. Not an emergency service

WellNest does not provide emergency medical services.

If you experience a medical emergency, contact local emergency services or attend the nearest emergency facility immediately.

7. Patient obligations

You agree to:

• Provide complete and accurate medical information
• Disclose medications, supplements, and prior conditions
• Follow treatment guidance responsibly
• Seek further care if symptoms deteriorate

Failure to provide accurate information may affect clinical outcomes.

8. Informed consent

By proceeding with any consultation or service, you confirm that:

• The nature, purpose, and limitations of services have been explained
• You have had the opportunity to ask questions
• You consent voluntarily to assessment and treatment
• You understand that certain services may be preventative or wellness focused rather than curative

9. Prescriptions and dispensing

• Prescriptions are issued only where clinically justified and legally permitted
• No consultation guarantees a prescription
• WellNest may facilitate dispensing of medication or supplements where allowed by law
• All prescribing and dispensing decisions remain the responsibility of the treating practitioner

10. Fees and payments

• Fees are payable in advance unless otherwise agreed
• Services may not be reimbursed by medical aid schemes
• Late cancellations (within 24 hours) may be charged in full
• No refunds once services have commenced

Pricing may change without prior notice.

11. Data protection and confidentiality

WellNest complies with the Protection of Personal Information Act (POPIA).

• Medical and personal information is treated as confidential
• Data is stored securely
• Information is shared only with authorised practitioners or where legally required

By using WellNest services, you consent to lawful processing of your personal and medical data.

12. Limitation of liability

To the fullest extent permitted by South African law:

• WellNest is not liable for independent clinical decisions made by practitioners
• WellNest is not liable for medical outcomes or adverse events
• Liability is limited to fees paid for services rendered

Nothing in these Terms limits liability for gross negligence or willful misconduct where prohibited by law.

13. Termination of services

WellNest reserves the right to refuse or discontinue services where:

• There is abusive or inappropriate behaviour
• Medical risk is deemed unacceptable
• Legal or regulatory obligations require termination

14. Intellectual property

All website content, branding, materials, and protocols are the intellectual property of WellNest unless otherwise stated. Unauthorised use is prohibited.

15. Governing law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute shall be subject to the exclusive jurisdiction of South African courts.

A. Telehealth consent

Telehealth Consultation Consent

By proceeding with a telehealth consultation through WellNest, you acknowledge and agree that:

1. Telehealth involves the use of electronic communications to enable medical consultation where the patient and practitioner are not in the same physical location.
2. Telehealth consultations are limited to patients physically located within South Africa.
3. Telehealth may not be appropriate for all conditions and does not replace physical examination where clinically required.
4. Technical failures, interruptions, or data transmission limitations may occur.
5. You may withdraw consent to telehealth at any time and request an in person consultation.

You confirm that:

• You have disclosed accurate information
• You understand the limitations of telehealth
• You consent voluntarily to this form of consultation

B. IV therapy and wellness treatments consent

IV Therapy and Adjunct Wellness Consent

By electing to receive IV therapy or wellness based treatments, you acknowledge that:

1. IV therapies may be used for hydration, nutrient replenishment, or wellness support.
2. Such therapies may be adjunct or preventative in nature and are not a substitute for standard medical treatment.
3. Potential risks include bruising, infection, allergic reactions, vein irritation, dizziness, or other adverse effects.
4. Results vary between individuals and are not guaranteed.
5. Treatment protocols may be modified or discontinued based on clinical assessment.

You confirm that:

• Risks and benefits have been explained
• You have had opportunity to ask questions
• You consent voluntarily to treatment

C. Peptides, supplements and advanced wellness consent

Advanced Wellness and Supplementation Consent

By participating in advanced wellness protocols or receiving supplements, you acknowledge that:

1. Some wellness interventions may be preventative or supportive rather than curative.
2. Certain supplements or protocols may be prescribed off label or as part of a wellness program, within legal and ethical guidelines.
3. Scientific evidence may vary depending on the intervention.
4. You have disclosed all current medications and supplements to avoid interactions.
5. You understand that outcomes cannot be guaranteed.

• You understand the nature of these interventions
• You accept potential risks and limitations
• You consent voluntarily

D. General acknowledgement

By proceeding with WellNest services, you confirm that:

• You have read and understood all applicable consents
• You have had sufficient opportunity to ask questions
• You consent freely without coercion
