These Terms apply to your use of www.wellnest.gold as a visitor.

If you book a medical consultation, you will be shown our WellNest Master Patient Agreement in full at the time of booking and asked to accept it there. The Patient Agreement is the document that governs your patient relationship with WellNest; it is published at https://bookings.wellnest.gold/terms-and-conditions. If you use our on-site services (IV therapy or facility modalities), separate consent forms apply, which you sign on site. These Website Terms cover only your browsing of our marketing website.

1. About these Terms

These Website Terms of Use govern your access to and use of www.wellnest.gold (the “Website”).

The Website is operated by Well Nest Multidiscipline Practice (Pty) Ltd (trading as WellNest and WellNest Gold), a company incorporated in South Africa under CIPC registration number 2025/508895/07, with its trading address at 183 Bree Street, Cape Town, 8001. This is also our address for service of legal process.

By accessing or using the Website you agree to these Terms. If you do not agree, please do not use the Website.

2. The Website is informational

The Website provides general information about WellNest and the services we offer. The Website does not provide medical advice. Information published on the Website is not a substitute for consultation with a qualified healthcare practitioner.

If you have a medical concern, contact a healthcare practitioner. In the event of a medical emergency, contact your local emergency services immediately.

3. Accuracy of information

We take reasonable care to ensure that information on the Website is accurate at the time of publication. However:

1. information may change without notice;
2. we do not guarantee the accuracy, completeness or currency of any information;
3. practitioner availability, services offered and pricing displayed on the Website may not always reflect current availability, so please verify when booking.

4. Acceptable use

You agree to use the Website only for lawful purposes. You agree not to:

1. use the Website in a way that could damage, disable, overburden or impair the Website or interfere with any other person's use;
2. attempt to gain unauthorised access to any part of the Website, the systems or networks connected to it, or any account or data on it;
3. use any automated means to access, scrape, mine or copy material from the Website;
4. introduce viruses, malware or other harmful code;
5. impersonate any person or misrepresent your identity;
6. use the Website to transmit unlawful, harmful, defamatory or offensive material.

All content on the Website, including text, images, branding, logos, video, design and code, is the intellectual property of WellNest or its licensors. You may view and download Website content for your personal, non-commercial use only.

You may not reproduce, republish, distribute, modify, create derivative works from, sell or commercially exploit any Website content without our prior written permission.

6. Third-party links

The Website may contain links to third-party websites and services. We are not responsible for the content of those third-party websites or for the way those third parties handle your information. Their own terms and privacy notices apply when you use them.

7. Contact form

If you submit a message through the Website's contact form, your message and contact details are sent to us by email through our email delivery partner. We use this information only to respond to your enquiry. We do not use information you submit through the contact form for advertising or marketing, and it is not included in the advertising measurement described in clause 8.

8. Cookies, analytics and advertising

Our Website uses cookies and similar technologies for basic website functionality, to understand how visitors use the Website, and to measure the performance of our online advertising (for example, to understand which of our adverts led to a booking). Where you accept advertising cookies, we may also use these technologies in future to show you relevant adverts on other websites and platforms you visit.

Separately, where you book certain services through our booking systems and opt in to the optional advertising-measurement question, we also measure advertising performance using information from your booking, as described in our Website Privacy Notice.

4. loss or damage caused by viruses or other harmful code that may infect your equipment as a result of your use of the Website.

10. Changes to these Terms

We may update these Terms from time to time. Updated Terms take effect when published on the Website. Continued use of the Website after publication of updated Terms constitutes acceptance.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa and any and all disputes arising from or in connection with this agreement and/or service provided, must be brought in any competent forum within the territorial jurisdiction of the Republic of South Africa.
